The Central Jakarta District Court panel granted the Koalisi Ibu Kota's lawsuit related to air pollution. The judge stated that the government, the defendant, in this case, had committed an unlawful act on Thursday (16/9).
The judge stated that the defendants, in this case, had committed unlawful acts related to handling air pollution. The defendants, in this case, are President Joko Widodo (Jokowi), the Minister of Environment and Forestry, the Minister of Home Affairs, the Minister of Health, and the Governor of DKI Jakarta. In addition, there are also defendants, namely the Governor of Banten and the Governor of West Java.
President Joko Widodo was sentenced to set national ambient air quality standards that are sufficient to protect human health, the environment, and ecosystems, including the health of sensitive populations based on scientific and technological developments.
Furthermore, the panel of judges sentenced the Minister of Environment and Forestry, Siti Nurbaya Bakar, to supervise the Governor of DKI Jakarta (Anies Baswedan), Governor of Banten (Wahidin Halim), and Governor of West Java (Ridwan Kamil) in conducting an inventory of cross-border emissions of DKI Jakarta, Banten, and West Java provinces.
Meanwhile, the Minister of Home Affairs, Tito Karnavian, was asked by a judge to supervise and guide the performance of the Governor of DKI Jakarta in controlling air pollution. And the panel of judges also sentenced the Minister of Health to calculate the reduction in health impacts due to air pollution in DKI Province, which needs to be achieved as the basis for consideration of Defendant 5 (Governor of DKI) in formulating strategies and action plans for controlling air pollution.
Meanwhile, the Governor of DKI Jakarta, Anies Baswedan, was sentenced to do four things, namely:
a. Supervise everyone on the provisions of the legislation in the field of air pollution control and or the conditions of environmental documents.
b. Imposing sanctions on every person who violates the law in the field of air pollution and or the provisions of environmental documents.
c. Disseminate monitoring evaluations and imposing sanctions related to air pollution control to the public
d. Establish regional ambient quality standards for DKI Province that are sufficient to protect human health, the environment, and ecosystems, including population health based on the development of science and technology
Another punishment that Anies must carry out is to take an inventory of ambient air quality, potential sources of air pollutants, meteorological and geographical conditions, and land use by taking into account the distribution of emissions from polluting sources involving the public. Lastly, Anies was sentenced to determine regional ambient air quality status every year, announce it to the public, formulate and implement strategies and action plans for air pollution control. The judge said this should be done in a focused manner and involving public participation.
The Koalisi Ibu Kota submitted the lawsuit regarding Jakarta's air pollution to the Central Jakarta District Court on July 4, 2019. The defendants were deemed to have violated Law Number 32 of 2009 concerning Environmental Protection and Management and the provisions of all relevant laws and regulations.
